Disclosure Statement for Payment Facility

This Disclosure Statement forms part of the Terms of Use in relation to your use of the Treasure Map website and the products, services and software provided by Treasure Map ("Services").

Before you ("you", the "End User", “User” or the "Merchant") use the Services, you must first read and accept all of the terms and conditions of the Terms of Use and the Treasure Map Privacy Policy. Your access to or the use of the Services constitutes your acceptance to be bound by the terms and conditions of the Terms of Use (which includes this Disclosure Statement) regardless whether or not you have clicked to accept the terms where such option is made available to you. If you do not agree to be bound by the Terms of Use, you must not use or access the Services.

The Terms of Use may be amended from time to time, and without prior notice, by Treasure Map (“Treasure Map”, “we”, “us” and “our”) posting the amended terms on this website. If you do not agree to us, at our sole discretion and without prior notice, amending the Terms of Use, you must not use or access the Services. Your continued access or use of the Services constitutes your acceptance of the terms of the amended Terms of Use and your representation that you are of legal age to form a binding contract and be bound.

The Terms of Use and all subsequent amendments to it are referred to as "Essential Terms".

Purpose of Disclosure Statement

The purpose of this Disclosure Statement is to provide you with some of the information you require before you make a decision to use the Treasure Map payment facility.

You agree that this Disclosure Statement is current as at the date of the statement but we may make changes to the statement from time to time. When changes are made, the new or amended Disclosure Statement will be made available to you from within the website or through the Services. We suggest to you that you re-read the Disclosure Statement from time to time and before you use Treasure Map payment facility in order to stay informed of any changes. You understand and agree that if you use the Services after the date on which the Disclosure Statement has changed, your use will be treated as your acceptance of the amended or new Disclosure Statement.

Payment Facility

You may make payment for the products and services within the Treasure Map website by using your credit card or the PayPal service (Payment Facility). You acknowledge and agree that in addition to the Essential Terms, you are bound by the terms of use of your credit card and the PayPal service, including but not limited to the fees and charges applicable. It is your responsibility to read, understand and comply with the Essential Terms and the terms of use of the payment facility and if you do not agree with them, you should not proceed with the use of them.

You acknowledge that Treasure Map does not verify the payment facility or the source of funds in the payment facility.

When you use your credit card or PayPal service to pay for a purchase, you may be subject to the fees and/or interest charged by your credit card or PayPal. These fees are not charged by us. If you have any queries in relation to your use of your credit card or PayPal service, you must direct them to the respective facility and not to us.

For your convenience, you may make payment into your Treasure Map E-Wallet (“E-Wallet”) where the amount paid is held in your E-Wallet for payment of future purchases within the Treasure Map website. You may hold up to Australian Dollars 1,000 in your E-Wallet at any one time. Should you require payment in excess of this limit, you should use one of the other payment facility within the website. You can check your balance in your E-Wallet and obtain information on recent transactions through your E-Wallet when you are logged into the Treasure Map website. Once the funds are paid into your E-Wallet, you may use them to purchase goods or services within the Treasure Map website. You may not withdraw the funds in your E-Wallet for any other purposes or withdraw them to any bank account you hold.

If you hold a balance in your E-Wallet, your funds will be deposited and held by us with a licensed bank in Australia. This does not affect your rights to withdraw funds from your E-Wallet to purchase goods and services within the Treasure Map website. Your funds are held solely for your use within the Treasure Map website. By using you understand and agree that no interest will be earned on your funds in the E-wallet.

We may, but not obliged to, place a hold on funds received into your E-Wallet or place a hold on transactions in your E-Wallet. This may occur for a variety of reasons including suspected fraud, if you abuse the Treasure map Services or if you breach any of the Essential Terms. If this happens, we will promptly investigate and attempt to resolve the issue and once the issue is resolved, we will promptly seek to restore access to your E-Wallet. To assist us with our investigations, you may be required to provide information to us. You acknowledge that restoring access to your E-Wallet or releasing the hold on transactions may take time and until it is restored you will not be able to use your E-Wallet to make any payment.

Whilst we make every attempt to ensure that the payment facility is available to users at all times, it is possible they may be rendered temporarily unavailable to some or all users from time to time. You agree that we are not responsible for and we disclaim all liability for any loss or damage (whether actual, special, directly, indirectly or consequential) of every kind and nature, known or unknown, suspected and unsuspected, disclosed or undisclosed, arising out of or in any way connected with the unavailability of the payment facility.

Risks associated with using the Payment Service

You acknowledge that there is the risk that the payment facility may be compromised and subject to an account takeover, unauthorised transactions or other type of fraudulent activity. You must familiarise yourself with the steps to handle such unauthorised transactions by reading the terms and conditions of each of the payment facility.

You are solely responsible for maintaining the confidentiality of any logins, passwords and your account and agree to immediately notify Treasure Map of any unauthorised use of your password or account or any other breach of security. You are fully responsible for all activities that occur under your account including your E-Wallet, with or without your knowledge and whether or not you have notified Treasure Map of any unauthorised use.

Subject to the terms and conditions of the payment facility, Treasure Map does not and cannot limit the amount you can pay from the payment facility.

Mediation and Dispute Resolution

We are committed to dealing with customer complaints fairly and resolving issues in a timely manner in accordance with its procedures for the handling of complaints.

If for any reason you have found an error in an advertised item or are dissatisfied with the service provided by Treasure Map, please refer to our refund policy and if appropriate contact us from the link supplied in the respective section. If you have a complaint against a Merchant regarding a purchase you have made through the Treasure Map service where you are requesting a refund and you believe after referring to the refund policy you are entitled to a refund of your payment, you are required to make a written complaint to Treasure Map within 24 hours of your presentation of coupon for the goods or services or the Merchant’s provision (or refusal of provision) of goods or services to you. Your complaint should be by an email with the details of the Merchant, the product and the basis of the complaint. Your complaint will be investigated and appropriate action will be taken to resolve the dispute. You agree that it is the sole discretion of Treasure Map acting reasonably to determine the outcome of the dispute and the User and Merchant agree to be bound by Treasure Map’s determination. Both the User and the Merchant agree that Treasure Map’s determination of the dispute will be final and the appropriate party will be liable to pay or refund the amount in dispute. Both the User and the Merchant agree that the limit of all liability by any party shall not exceed the amount of the purchase from the Merchant. Each party will bear its own costs in relation to the dispute.

If the User or Merchant disputes or reverses a payment to Treasure Map through the payment facility and they are deemed to have done so without an appropriate reason or not in good faith, the User or Merchant will be liable to pay all costs and expenses incurred by Treasure Map in defending the dispute.

If you are a Merchant and a buyer files a claim in relation to your sale of any goods or services and you are found, in our sole discretion, to be in breach of any of the Essential Terms or we become aware of any fraudulent or inappropriate activity, you authorise Treasure Map to refund the payment to the buyer and you will be liable to us for any costs or fees incurred by us as a result of the refund. If you have already received the payment for your goods or services (less our charges), you will be liable to refund the amount in full and/or you authorise funds from any future sales be held by us to cover the refund and to cover any costs incurred by us in the recovery of these funds.

If you as a Merchant has received payment for your goods or services (less our charges) and the payment is subsequently reversed for any reason, you will be liable to us for the amount of the reversed transaction plus any fees or costs incurred by us as a result of the reversal.

We encourage you to try and resolve disputes with other users or Merchants directly with them. Some forms of payment facility permitted on the Treasure Map website, such as PayPal or credit card, may offer buyers and sellers mediation and dispute resolution processes and you should familiarise yourself with them before proceeding with a transaction of any kind.

If you have a complaint about a seller or a buyer, you should contact the seller or buyer directly and provide a copy of your complaint sent to us.

If you have a complaint about the PayPal Service, you should contact PayPal directly.

If you have a complaint about your Credit Card, you should contact your credit card company directly.

Whilst we endeavour to resolve a complaint about Treasure Map Services within 10 business days of receipt of complaint, in some instances it may not be possible. We endeavour to resolve all complaints within a maximum time frame of 45 days.

If a complaint about Treasure Map Service is not resolved or if you are not satisfied with our resolution or handling of your complaint, we encourage you to try and resolve the disputes by way of an independent mediation or arbitration entity at either party’s election. You and Treasure Map agree to be bound by the outcome of such mediation. Each party will bear its own costs (and split equally any joint costs) of mediating the dispute.
